You are solely responsible for your User Content, including:

• The functionality and safety of your mods
• Any damage or issues caused by your User Content
• Ensuring you have the right to upload and share your content
• Compliance with game publishers' terms and modding policies
• Compliance with applicable laws and these Terms

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third-party rights
• Your User Content does not contain malicious code or harmful content
• Your User Content complies with these Terms

We are not responsible for User Content uploaded by creators. Users download and use mods at their own risk.

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, trojans, or harmful content
• Upload pirated game content, cracks, or license bypasses
• Share illegal, obscene, or harmful content including hate speech
• Upload content depicting violence, illegal activities, or exploitation
• Harass, abuse, threaten, or harm other users
• Spam or engage in unauthorized advertising
• Attempt to gain unauthorized access to the Service or other accounts
• Impersonate others or misrepresent your affiliation
• Scrape, data mine, or use automated tools without permission
• Launch denial-of-service attacks or attempt to disrupt the Service

We recognize that modding exists within the legal framework established by game publishers and copyright holders.

Modding.io celebrates the rich tradition of fan-made content and the vibrant modding communities that enhance gaming experiences. Many game publishers explicitly allow, encourage, or provide tools for modding as part of their games' ecosystems. We deeply respect these policies and work to support legitimate modding activities.

Our Commitment to Publishers:

• We respect each publisher's unique modding policies and terms of service
• We will honor takedown requests from publishers regarding their intellectual property
• We actively cooperate with publishers to enforce their modding guidelines
• We prohibit content that violates specific publisher policies, even if legal elsewhere
• We encourage modders to review and comply with each game's official modding policy

While we support the modding community, we understand that publishers retain full rights over their intellectual property. When a publisher indicates that modding is not permitted for their game, we will respect that decision and remove such content from our platform.

We recognize that the modding community creates a wide variety of content, including renders, artwork, screenshots, videos, and other creative works that may incorporate game assets or intellectual property.

Our Approach to Fan Content:

We support fan creativity and derivative works where publishers permit such use. Many game publishers have explicit fan content policies that allow community members to create and share works using game assets for non-commercial or specified purposes.

Your Responsibilities:

• Review and comply with the specific fan content or community guidelines for each game
• Respect any restrictions on commercial use, asset extraction, or redistribution
• Credit original creators and respect trademark usage guidelines
• Clearly indicate that your work is fan-made and not official
• Do not upload content if the publisher explicitly prohibits fan-made derivative works

By uploading fan content or derivative works, you represent that you have reviewed the applicable publisher's policies and believe your use is permitted under those policies or applicable law (such as fair use or fair dealing).

Note: When in doubt, check the game's official website, community guidelines, or modding documentation for their fan content policy. If you cannot find a clear policy or are unsure, err on the side of caution or contact the publisher directly.

We have a zero-tolerance policy for piracy and copyright infringement.

Modding.io is a platform for legitimate game modifications that enhance legally owned copies of games. We firmly condemn piracy and any attempts to circumvent game purchases or protections.

The following are strictly prohibited:

• Pirated games, game files, or illegally obtained copyrighted assets
• Cracks, keygens, license bypass tools, or DRM circumvention
• Content that allows users to avoid purchasing legitimate copies of games
• Game executables, core game files, or substantial portions of games
• Copyrighted music, movies, or media unrelated to legitimate modding
• Assets extracted from games without proper authorization or fair use justification
• Any content that infringes on intellectual property rights

Important Distinction: Modding vs. Piracy

Legitimate mods enhance, modify, or add to games that users legally own. They do not replace the need to purchase games or bypass licensing. Users must own legitimate copies of games to use mods from our platform.

Users found uploading pirated content will have their accounts immediately suspended or terminated. We cooperate fully with copyright holders, publishers, and law enforcement regarding piracy and intellectual property violations.

When in doubt, ask: Does this mod require users to own a legitimate copy of the game? If not, it doesn't belong here.

The Service and its original content (excluding User Content), features, and functionality are owned by Modding.io and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks may not be used without our prior written consent.

We respect intellectual property rights. If you believe that content on our Service infringes your copyright, please notify us with the following information:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material and its location
• Your contact information (email, phone number, address)
• A statement that you have a good faith belief that the use is unauthorized
• A statement of accuracy and your authority to act on behalf of the owner
• Your physical or electronic signature

Please note that filing false copyright claims may result in legal liability. We will remove infringing content and may terminate repeat infringers' accounts.

We reserve the right to review, monitor, and moderate User Content to ensure compliance with these Terms. We may:

• Remove or refuse to publish any content that violates these Terms
• Suspend or terminate accounts that repeatedly violate our policies
• Cooperate with law enforcement regarding illegal content
• Take any action we deem necessary to protect users or the Service

We are not obligated to pre-screen content but reserve the right to do so. Content moderation decisions are made at our sole discretion.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Modding.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the “Last updated” date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
